CIB 375: COVID-19 response - Remote witnessing of statutory declarations

Landgate wishes to advise the extension of the remote witnessing provisions as outlined in the COVID-19 Response and Economic Recovery Omnibus Act 2020 (CRERO Act).

Due to the COVID-19 pandemic, the arrangements previously outlined in CIB-343 were enacted to enable remote witnessing of statutory declarations for the purposes of the Transfer of Land Act 1893.

Remote witnessing is when the witness and the person executing the document can see and hear each other, whether by audio-visual communication (e.g. Skype, Zoom, Microsoft Teams etc) or in person.

Full details of the remote witnessing provisions are outlined in section 3.1 of the Policy and Procedure Guide DOC-04 Statutory Declarations and Supporting Evidence.

The extension of these provisions will be in place until 31 December 2022.

The witnessing arrangements for other documents lodged at Landgate remain unchanged.

Landgate continues to monitor developments and ensure plans are in place to respond to any COVID-19 scenarios that may impact our customers. Should the circumstances change, we will advise accordingly.
