WA Participation Rules

Users of the Electronic Lodgment Network (ELN) such as conveyancers, lawyers and mortgagees, are called Subscribers. Subscribers must comply with the WA Participation Rules. 

Section 23 of the Electronic Conveyancing Act 2014 (ECA) authorises the Registrar of Titles (the Registrar) to determine the Participation Rules relating to the use by Subscribers of an Electronic Lodgment Network.  

In determining the Participation Rules, ECA s24 requires the Registrar to have regard to the desirability of maintaining consistency with any model provisions. ARNECC published Model Participation Rules Version 7 (MPRv7) in January 2024.  

WA Participation Rules Version 7 (WAPRv7) has been prepared having regard to MPRv7.  

WAPRv7 comes into effect in Western Australia on 28 March 2024. Refer to WA Participation Rules Version 6 for the current version effective from 12 April 2021 to 27 March 2024.

WA Participation Rules Version 7 marked up is a version showing the changes made between Version 6 and Version 7.

Waivers 

Under section 27(2) of the ECA, a waiver from the obligation to comply with a provision of the Participation Rules may be granted if it is reasonable in all the circumstances. 

There are no current waivers of the version 7 Participation Rules in WA.
