Electronic Conveyancing: publication of Western Australia’s Participation Rules (version 3) and Operating Requirements (version 3)

The Western Australian (WA) Registrar of Titles has formally determined amendments to the Electronic Conveyancing Act 2014, and subsequently a notice appeared in the WA Government Gazette on Friday 16 October 2015:

WA Participation Rules version 3

Notice is given that under section 23(1) of the Electronic Conveyancing Act 2014, the Registrar of Titles has determined that WA Participation Rules version 3 will come into effect on 9 November 2015. In accordance with section 25 of the Act, the WA Participation Rules version 3 was published on Landgate’s website.

WA Operating Requirements version 3

Notice is given that under section 22(1) of the Electronic Conveyancing Act 2014, the Registrar of Titles has determined that WA Operating Requirements version 3 will come into effect in WA on 9 November 2015. In accordance with section 25 of the Act, the WA Operating Requirements version 3 was published on Landgate’s website.

The Australian Registrars’ National Electronic Conveyancing Council’s (ARNECC) website has the marked up versions to the Model Participation Rules and Operating Requirements, on which the WA rules and requirements are based.

ARNECC has produced Guidance Notes to support the practical implementation of the Participation Rules by licensed settlement agents, legal practitioners and mortgagees, which are also available online.
