CIB 409: Request to Expedite and Request to Withdraw Registration Process Amendments

The Registrar of Titles has made a minor amendment to the current practice and procedures relating to “Requests to Expedite the Processing of Plans and Documents” and “Requests to Withdraw a Document from Registration”.

Requests to Expedite the Processing of Plans and Documents

While the current policy allows a party to a land transaction to request urgent processing of their document through their legal representative, this does not extend to allowing settlement agents to make the written request on behalf of their client.

From the date of this Customer Information Bulletin, the Registrar will allow a settlement agent who has prepared a land transaction document, as authorised under the Settlement Agents Act 1981, to sign a letter on behalf of their duly appointed client to request urgent processing of the document.     

Please note that no changes have been made to the strict evidential requirements and standards that must be met before any request for urgency can be considered.

These evidential requirements and standards are outlined in the Land Titles Registration Policy and Procedure Guide LOD-05 - "Request to Expedite the Processing of Plans and Documents".

Requests to Withdraw a Document from Registration

Under the current Policy, a letter to request the withdrawal of a document from registration that has been correctly prepared and waiting in the queue to be registered, must be signed by all parties to the document and by all parties that could be affected by withdrawal of the document.

From the date of this Customer Information Bulletin, the Registrar will allow a duly appointed legal representative or licensed settlement agent acting for any of the parties to the land transaction document to sign the written request on behalf of their client.

Please note that all of the other requirements outlined in the Land Titles Registration Policy and Procedure Guide LOD-07 under Heading 6 – “Withdrawal of Documents from Registration” still apply when withdrawing documents that have been correctly prepared and waiting in the queue to be registered.
