CIB 329: Increased scope for electronic lodgement of land registry documents in relation to evidence

Effective from 16 March 2020 you will be able to upload evidence and attach it to all documents within an electronic workspace. This will enable lodgement of the following transactions electronically:

  • Mortgages, discharge of mortgages, caveats and withdrawal of caveats where a party in the transaction is considered an incapable person pursuant to a State Administrative Tribunal (SAT) order. The SAT order and statutory declaration(s) must be uploaded and attached with the document.
  • Withdrawal of caveat where a caveator is deceased. The death certificate/grant of probate/letters of administration, and statutory declaration must be uploaded and attached with the document.
  • Caveat of part of the land with a narrative land description, such as over a hachured portion on an attached sketch or plan. The sketch or plan must be uploaded and attached with the caveat.
  • Caveat where the caveator wishes to provide evidence to the Registrar of Titles to show that s138B to s138D of the Transfer of Land Act 1893 does not apply. Evidence to support the claim must be uploaded and attached with the document. For further information on these caveat claims refer to s138A of the Transfer of Land Act 1893.
  • Transfers where a restrictive covenant affecting the land has expired. The letter of request to remove the covenant must be uploaded and attached to the document.

Please note the following:

  • Paper lodgement of all documents containing the increased scope will be accepted until 30 March 2020.
  • In-flight transactions will not be affected and documents containing the increased scope dated prior to 30 March 2020 will continue to be accepted in paper.
