CIB 306: Extension of transition period for electronic lodgement of eligible land title documents

On 24 November 2017, Transfer of Land Regulations were gazetted requiring the electronic lodgement of the following classes of registry instruments by 1 May 2018.

  • all eligible, stand-alone transfers, caveats and withdrawal of caveats, and
  • any lodgement case consisting of eligible discharges, transfers, mortgages, caveats and withdrawal of caveats and eligible land title documents.

In accordance with powers granted under Transfer of Land Regulation 8F(1)(a), the Registrar of Titles has granted a general exemption on public interest grounds from the requirement to electronically lodge the above classes of Registry instruments until 1 December 2018.

This action will ensure a smooth industry transition and give all industry practitioners time to adjust to electronic conveyancing.

The Registrar appreciates that many practitioners and industry participants are already transacting electronically and strongly urges the remainder of the industry to transition to electronic conveyancing as soon as possible, but certainly before 1 December 2018 when the general exemption will expire.
